Legal and regulatory framework


   The legal and regulatory framework that regulates the privatization programme is composed primarily of the following texts:

 Laws

 Law N° 89-9 of February 1st, 1989 relative to public sector participations, enterprises and establishments modified and completed by the law N° 94-102 of August 1st, 1994, the law N° 96-74 of July 29, 1996, the law N° 2001-33 of March 29, 2001, and the law N°36-2006 of June 12, 2006.
  The Law N° 85-109 of December 31, 1985 bearing the Law for finances for the year 1986 relative to the creation of the special treasury fund (fund for the restructuring of the capital of public enterprises) modified by the Law n°89-115 of December 30, 1989 relative to the Law for finances for the year 1990. 

 Decrees

 Decree N° 96-270 of February 14, 1996 fixing the attributions of the Ministry of Economic Development that is modified by the Decree N° 96-1225 of July 1st, 1996.
 Decree N° 96-271 of February 14, 1996 relative to the organisation of the Ministry of Development that is modified and completed by the Decree N° 96-1226 of July 1st, 1996.
 Decree N° 97-410 of February 21, 1997 fixing the composition of CAREPP as well as the composition and the attributions of CTP modified and completed by the Decree N° 98-1440 of July 13, 1998.
 Decree N°2000-2280 of October 10, 2000, relative to the methods of naming and the conditions of remuneration of liquidators of public sector establishments and enterprises and the methods and procedures for approval of the liquidation programme.
 Decree N° 2002-2130 of September 30,2002 relative to the attachment of the structure (relevant previously to the ex-Ministry of Economic Development) to the Prime Ministry.

 Circulars

 Circular N° 33 of June 21, 1989 relative to management, guardianship, restructuring and list of public enterprises. 
 Circular N° 21 of April 21, 1990 relative to the ceding of shares or assets and the taking in of new participation by the participants or public enterprises. 
 Circular N° 3 of January 29, 1992 relative to the methods of the sales of assets of the enterprises that have public sector participation.
 Circular N° 55 of August 11, 1993 relative to the attribution and procedure to follow for privatisation operations. 
 Circular N° 15 of March 30, 1995 relative to the attribution and procedure to follow for privatization operations. 
 Circular N° 19 of June 02, 1998 relative to the participation of banks in the capital of enterprises with public participation.
